Although the Competition Appeals Tribunal ruled against us, the issues raised by our case continue to resonate, particularly given subsequent events and disclosures.


Given your earlier support, we thought you may be interested to know that Vince Cable MP, Liberal Democrat Deputy Leader and Treasury Spokesman, has tabled various Parliamentary Questions regarding the "secret dossier" of evidence used by the UK Government in the CAT, and what it contained.  He has asked for the dossier now to be made public and has attracted cross-party support.  Additionally, Margo Macdonald MSP has submitted a Freedom of Information request for disclosure of all relevant information regarding the takeover.
 
At the Scheme of Arrangement hearing which ratified the takeover of HBoS, it is reported that Lord Glennie was told "all copies of the "secret dossier" had been destroyed".  He therefore did not have the opportunity to satisfy himself, had he wished to do so, that shareholders of both HBoS and Lloyds TSB were aware of any relevant facts contained in dossier.
 
For your information, both banks involved acted honourably throughout the case, and immediately upon conclusion of the CAT informed us that they would not make any claim for costs incurred in putting their evidence to the Competition Appeals Tribunal.  The MAG group has also informed the CAT that we will bear our own costs for bringing this matter to the public attention.
 
Despite the continued public interest, the UK Government has indicated it wishes to continue to pursue MAG for costs. We await a decision on this matter from the Competition Appeals Tribunal.
